1. TERMS AND CONDITIONS

• The Terms and Conditions apply to all bookings made with the Company L. Driver Media, and when The Client(s)' books our service, this means they have accepted and understood these Terms and Conditions.

​

• You must be least 18 years or older to make a booking with L. Driver Media.

​

• The Client(s) cannot change or alter The Terms and Conditions, unless certain conditions are verbally discussed and agreed, and have been confirmed in writing, in advance, by L. Driver Media. 

​​

• L. Driver Media reserves right to refuse any booking at its own discretion. 

​

• The Terms and Conditions presented do not affect statutory rights.

​

2. DEFINITIONS

​

• L. Driver Media includes any person who has been hired by L. Driver Media to work in any capacity on the Commission by The Client(s).

​

• The Client(s) shall be that/those person(s) defined as their Full Name and/or Company Name on the booking form, whether a direct client of L. Driver Media or an agency or otherwise, and the expression The Client(s) shall where the context so admits include its respective assignees, sub-licensees and successors in title.

​

• The Commission shall mean the booking of L. Driver Media by The Client(s) to perform videography, and editing services in consideration of the Fee.

​

• The Fee shall mean the Fee for completion of the Commission by L. Driver Media.

​

• Copyright means the ownership and rights to the Final Materials.

​

• Final Materials means the video images collected, edited, produced and presented by L. Driver Media for the intent of the Commission by The Client(s), and presented in the manner and quantity agreed at the time of The Client(s) booking.

3. PRICES

​

• All standard Commissions and additional goods specified on the booking form or on the L. Driver Media website are supplied at the prices ruling on the date of booking. Goods not specified at time of original booking are supplied at the prices ruling at the time of receipt of the additional order.

​

4. COVERAGE

​

• Videography performed during the course of the Commission will be at the discretion of L. Driver Media. Although all efforts will be made to fulfill The Client(s) requirements.

​

• L. Driver Media shall be given artistic license in relation to the locations used, framing, positioning and compositions of shots, and staged poses. L. Driver Media's creative judgements regarding these matters shall be judged as correct choices. 

​

• L. Driver Media shall strive to record all individuals attending the Wedding as requested by The Client(s) at some point, but L. Driver Media shall not be held responsible on the occasion of leaving out any person, object or seen. 

​​

• When the Commission involves a church ceremony, and this applies to certain other venues, the movements by L. Driver Media could potentially be restricted ​by the official in charge of that said church or venue. The position from which L. Driver Media is able to cover said ceremony may not be of L. Driver Media’s choice. In the case of any potential obstructed view in the Final Materials, L. Driver Media cannot and should not be held responsible.

5. CONFIDENTIALITY

​

• Each party will keep confidential and will not disclose to any third parties or make use of information or material communicated to it in confidence for the purposes of the Commission, save as may be reasonably necessary to enable L. Driver Media to carry out its obligations in relation to the Commission.

​

6. PERSONAL ACCIDENT

​

• Any directions issued to The Client(s), their guests or employees during a Commission are deemed to be at said persons' own risk. L. Driver Media cannot be held responsible for any personal accidents during a Commission.

​

7. INDEMNITY

​

• The Client(s) shall be responsible for obtaining clearances in respect of third-party copyright works, trademarks, designs or other intellectual property and will indemnify L. Driver Media against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.

​

8. PAYMENT

​

• A non-refundable deposit of £100.00 will confirm The Client(s)' booking, this also means The Client(s)' have fully accepted these Terms and Conditions. The deposit will be deducted from the cost of The Client(s)' chosen package when calculating the final balance due.

​

• The Client(s) must make the full payment of the remaining balance 8-weeks before the date of the Commission. If The Client(s) fail to make the full payment at this time without a prior written agreement by L. Driver Media will result in the cancellation of The Client(s)' Commission.

​

• Any additional goods ordered must be paid for in full at the time of ordering.

​

• Titles to all goods remain with L. Driver Media until paid for in full by The Client(s).

​

• Credit card payments made by The Client(s) must be come along with a completed booking form, which contains the exact name, address and telephone number their credit card holder has on file for The Client(s).

​

• All orders will only be processed once permission of The Client(s) payment has been properly received.

​

9. EXPENSES

​​

• When The Client(s) requests for extra expenses outside the original brief of the Commission, The Client(s) shall be liable to pay for the extra expenses or fees as having been agreed or estimated.

​

10. DELIVERY

​

• L. Driver Media shall strive to deliver the Final Materials and additional orders to The Client(s) within the agreed time period. 

​

• Time for delivery shall not be the essence of the contract.

​

• L. Driver Media shall not be held be liable to The Client(s) for any direct or indirect loss, or for loss of profit occasioned by late delivery or on any other circumstances.

​

• Unless L. Driver Media has given The Client(s) prior permission for an extension, The Client(s) must give L. Driver Media approval of all their materials no later than 3 months after delivery of earliest approval versions. After this time, The Client(s) materials shall be assumed approved, and Final Materials will be provided without any changes.

​

12. REJECTION 

​

• The Client(s) has no right to reject Final Materials on the basis of artistic style or composition.

​

13. OWNERSHIP AND DISPLAY 

​

• L. Driver Media will hand over the entire Copyright of the Final Materials to the Client(s) once the Commission is completed, and the Final Materials have been successfully delivered to The Client(s).

​

• All video and audio digital files used during any Commission by L. Driver Media remain the property of L. Driver Media. On occasion, L. Driver Media may supply a copy of the unedited video digital files to The Client(s) for their own non-commercial use.

​

• The Client(s) shall give L. Driver Media permission to display any video images covered by their Commission, at any time and in any part of the world, for general business promotion in advertising and websites.   

​

14. CANCELLATION AND POSTPONEMENT!

​

• If The Client(s) should have to cancel a Commission, the following cancellation fees will become due immediately upon said cancellation:

​

• Cancellation or Postponement more than six months before the Commission - The deposit of at least £100.00.

​

• Cancellation or Postponement less than six months before the Commission - 50% of the price of the package booked.

​

• Cancellation or Postponement less than three months before the Commission - Full price of the package booked.

​​

• When a package hasn't been specified on the booking form, it will be considered that The Client(s) have chosen a package to the value of £900.00. The Client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation. Where L. Driver Media is able to re-book the date with an equivalent booking, the cancellation fee will be reduced to the deposit.

15. FORCE MAJEURE 

​

• The Client(s) shall not hold L. Driver Media liable for any failure in the performance of any of its obligations caused by any factors beyond its reasonable control.

​

• In the event that L. Driver Media is unable to attend the Commission due to any cause that is beyond reasonable control, examples being an injury, illness, flooding, victim of a crime, etc. L. Driver Media will strive to supply The Client(s) with a equivalent replacement in case of such event. ​

​

• In the event of a cancellation of the Commission by L. Driver Media due to Force Majeure, or in the very unlikely event of complete equipment failure, liability shall be limited to a full refund of any fees paid.

​

16. WAIVER

​

• Neither the demand for nor the acceptance of payment made under these Terms and Conditions, nor the failure by L. Driver Media to enforce any of the Terms and Conditions at any time or for any period will release or exonerate or in any way affect the liability of The Client(s) or be a waiver of these Terms and Conditions.
